[38 Wash2d Page 458] This action was instituted to compel specific performance of an oral contract to devise certain real property and bequeath the personal property located thereon. According to the allegations of the complaint, plaintiff was employed by Levi H. Hensel, referred to herein as Hensel, to perform household and nursing services during the last illness of Mrs. Hensel. This employment began in January, 1939, and continued, at an agreed compensation, for somewhat more than a month, when Mrs. Hensel died. Hensel then orally promised plaintiff that, if she would continue on as his housekeeper, he would, as compensation, [38 Wash2d Page 459] make a will leaving her the Seattle home and personal property located therein.
